What happens after VA finds an evidence-gathering error

VA explains that it closes the HLR and opens a new claim to obtain the missing evidence. It sends a letter outlining the corrective steps, then makes a decision using the evidence it gathered. See VA’s duty-to-assist explanation.

Underline the missing record, examination, or opinion named in the letter. Record any action requested from you. Another examination or medical opinion may be part of gathering that evidence; the letter and later notices provide the details for your case.

When the status stays at “collecting evidence”

“Collecting evidence” does not say what is missing. Use the correction letter to list each requested record, exam, or medical opinion. Add the date you sent a response or received an appointment notice.

VA’s waiting guidance directs you to respond to requests, attend scheduled exams, and contact VA if you have not heard back. Ask what VA is still waiting for in your claim; someone else’s wait time will not answer that.

How to use QuickSubmit for the current request

VA’s upload instructions direct decision-review and appeal evidence to QuickSubmit. Before uploading, check the current claim stage and the instructions in your correction letter.

• Identify the issue and document being submitted.
• Confirm the applicable instructions with VA or your representative if unclear.
• Save the submitted file, date, and receipt together.

A receipt shows you sent the file. It does not show that an examiner read it or that the review allows it. Check those questions separately with VA.

What if a medical opinion arrives after the exam is scheduled?

A nexus opinion is a clinician’s explanation of how a condition is linked to service or another condition. If that opinion arrives after VES or another provider schedules your exam, promptly check the instructions for sending it. Ask VA or your representative how to confirm that the report reached the claim file. Keep appointment questions with the scheduler.

VA’s exam guidance says to submit new non-VA medical records before the appointment. A provider may review copies brought to the exam but cannot submit them for you. Follow the appointment instructions while clarifying how the new report will be handled.

After HLR and a Supplemental Claim: read the latest letter

For a lower-back claim or any other issue with several reviews, build a short sequence from the actual notices:

• Decision challenged and its date.
• Review requested and the issue listed.
• Written result of that review.
• Any claim or evidence request now pending.

The next step can change after each decision. Use the most recent notice and the decision-review comparison to identify what you need to ask next. Ask your representative which request you can make now and when it is due.

Can HLR decide the issue without asking for more evidence?

HLR can change a decision using the existing record, but an informal conference or an online status change does not promise an immediate result. A DTA correction means VA still needs to gather missing evidence.
